Let them be 2
This is a continuation of the list of Halakhic rulings which rely on or approve of the common practice, despite the opposition of other poskim (note especially case # 6: drinking wine made by non-Jews in 17th C Moravia), and which is based on the rule:
הנח להן לישראל אם אין נביאים הן – בני נביאים הן
Let the Israelites be, the Divine Spirit is on them, they may not be prophets, but they are the children of prophets.
1. People decide what Berakha to say on certain foods, such as SheHakol on chocolate and not HaEtz as rigid Halakhic rules would dictate; 2. Answering Amen after the Berakha of a very young child; 3. Using, even in Pesah, malic acid made from the yeast of non-kosher wine; 4. Honoring with the first Aliyah of Shabbat Beresheet an Israel and asking the Cohanim to leave the shul; 5. Buying vegetables in the market (16th C Safed, Israel), without checking whether they were planted near vineyards.
6. Drinking wine made by Christians (R. Moshe Iserles, the author, limits his psak only to Moravia, and other countries where wine is the only available drink); 7. Pouring hot water directly on food and not to a Second Vessel (the author writes that any way people pay no heed to the warnings of the rabbis); 8. Buying immediately after Pesah bread which was baked by non-Jews during the holiday; 9. Drinking alcoholic beverages made by non-Jews despite concerns about ingredients and the process of boiling water. 10. Using a very small Etrog (a volume of 4 oz.).
11. Eating dried fruits without concern about bugs (after more than a year since production); 12. Using Etrog without concern of it being grafted; 13. Using saffron without checking for kashrut; 14. Charging less when paying upfront, which is in essence charging interest; 15. In a case of observant Jews whose non-observant partners decided to open the business on Shabbat, the author allowed them to keep working during the week and did not force them to get out of the business, as others demanded;
16. Eating Hadash outside Israel and not worrying about Orlah (fruit within the first 3 years) as a result of grafting and replanting vines; 17. Performing the sale of Hametz even for people who eat Hametz on Pesah; 18. Earing sardines with no supervision (dismissing concerns of kashrut of the oil and cooking by a non-Jew); 19. Allowing people to serve samples of wine in glasses which were not dipped in a Mikveh.
