Parashat Shoftim: Judges and Justice

"Justice, justice you shall pursue." Judges, kings, priests and prophets, the cities of refuge, and the laws of war, including the command not to destroy fruit trees.

You shall appoint magistrates and officials for your tribes, in all the settlements that your God יהוה is giving you, and they shall govern the people with due justice.

You shall not judge unfairly: you shall show no partiality; you shall not take bribes, for bribes blind the eyes of the discerning and upset the plea of the just.

Justice, justice shall you pursue, that you may thrive and occupy the land that your God יהוה is giving you.

You shall not set up a sacred post—any kind of pole beside the altar of your God יהוה that you may make—

or erect a stone pillar; for such your God יהוה detests.

You shall not sacrifice to your God יהוה an ox or a sheep that has any defect of a serious kind, for that is abhorrent to your God יהוה.

If there is found among you, in one of the settlements that your God יהוה is giving you, a man or woman who has affronted your God יהוה and transgressed the Covenant—

turning to the worship of other gods and bowing down to them, to the sun or the moon or any of the heavenly host, something I never commanded—

para ir a servir a otros dioses y postrarse ante ellos, o ante el sol, la luna, o todo el ejército del cielo, cosa que yo no he mandado;

and you have been informed or have learned of it, then you shall make a thorough inquiry. If it is true, the fact is established, that abhorrent thing was perpetrated in Israel,

you shall take the man or the woman who did that wicked thing out to the public place, and you shall stone that man or woman to death.—

A person shall be put to death only on the testimony of two or more witnesses; no one shall be put to death on the testimony of a single witness.—

Let the hands of the witnesses be the first to put [the condemned] to death, followed by the hands of the rest of the people. Thus you will sweep out evil from your midst.

If a case is too baffling for you to decide, be it a controversy over homicide, civil law, or assault—matters of dispute in your courts—you shall promptly repair to the place that your God יהוה will have chosen,

and appear before the levitical priests, or the magistrate in charge at the time, and present your problem. When they have announced to you the verdict in the case,

you shall carry out the verdict that is announced to you from that place that יהוה chose, observing scrupulously all their instructions to you.

You shall act in accordance with the instructions given you and the ruling handed down to you; you must not deviate from the verdict that they announce to you either to the right or to the left.

Should either party [to the dispute] act presumptuously and disregard the priest charged with serving there your God יהוה, or the magistrate, that party shall die. Thus you will sweep out evil from Israel:

all the people will hear and be afraid and will not act presumptuously again.

If, after you have entered the land that your God יהוה has assigned to you, and taken possession of it and settled in it, you decide, “I will set a king over me, as do all the nations about me,”

you shall be free to set a king over yourself, one chosen by your God יהוה. Be sure to set as king over yourself one of your own people; you must not set a foreigner over you, one who is not your kin.

Moreover, he shall not keep many horses or send people back to Egypt to add to his horses, since יהוה has warned you, “You must not go back that way again.”

And he shall not have many wives, lest his heart go astray; nor shall he amass silver and gold to excess.

When he is seated on his royal throne, he shall have a copy of this Teaching written for him on a scroll by the levitical priests.

Let it remain with him and let him read in it all his life, so that he may learn to revere his God יהוה, to observe faithfully every word of this Teaching as well as these laws.

Thus he will not act haughtily toward his fellows or deviate from the Instruction to the right or to the left, to the end that he and his descendants may reign long in the midst of Israel.

The levitical priests, the whole tribe of Levi, shall have no territorial portion with Israel. They shall live only off יהוה’s offerings by fire as their portion,

and shall have no portion among their brother tribes: יהוה is their portion, as promised.

This then shall be the priests’ due from the people: Everyone who offers a sacrifice, whether an ox or a sheep, must give the shoulder, the cheeks, and the stomach to the priest.

You shall also give him the first fruits of your new grain and wine and oil, and the first shearing of your sheep.

For your God יהוה has chosen him and his descendants, out of all your tribes, to be in attendance for service in the name of יהוה for all time.

Revi’i18:6–13

If a Levite would go, from any of the settlements throughout Israel where he has been residing, to the place that יהוה has chosen, he may do so whenever he pleases.

He may serve in the name of his God יהוה like all his fellow Levites who are there in attendance before יהוה.

They shall receive equal shares of the dues, without regard to personal gifts or patrimonies.

When you enter the land that your God יהוה is giving you, you shall not learn to imitate the abhorrent practices of those nations.

Let no one be found among you who consigns a son or daughter to the fire, or who is an augur, a soothsayer, a diviner, a sorcerer,

For anyone who does such things is abhorrent to יהוה, and it is because of these abhorrent things that your God יהוה is dispossessing them before you.

You must be wholehearted with your God

«Serás íntegro con Hashem tu Elohim.»

Those nations that you are about to dispossess do indeed resort to soothsayers and augurs; to you, however, your God יהוה has not assigned the like.

This is just what you asked of your God יהוה at Horeb, on the day of the Assembly, saying, “Let me not hear the voice of my God יהוה any longer or see this wondrous fire any more, lest I die.”

Whereupon יהוה said to me, “They have done well in speaking thus.

But any prophet who presumes to speak in My name an oracle that I did not command to be uttered, or who speaks in the name of other gods—that prophet shall die.”

And should you ask yourselves, “How can we know that the oracle was not spoken by יהוה?”—

if the prophet speaks in the name of יהוה and the oracle does not come true, that oracle was not spoken by יהוה; the prophet has uttered it presumptuously: do not stand in dread of that person.

When your God יהוה has cut down the nations whose land your God יהוה is assigning to you, and you have dispossessed them and settled in their towns and homes,

you shall set aside three cities in the land that your God יהוה is giving you to possess.

You shall survey the distances, and divide into three parts the territory of the country that your God יהוה has allotted to you, so that any [man] who has killed someone may have a place to flee to.—

Now this is the case of the killer who may flee there and live: one who has slain another unwittingly, without having been an enemy in the past.

For instance, a man goes with another fellow into a grove to cut wood; as his hand swings the ax to cut down a tree, the ax-head flies off the handle and strikes the other so that he dies. That man shall flee to one of these cities and live.—

Otherwise, when the distance is great, the blood-avenger, pursuing the killer in hot anger, may overtake him and strike him down; yet he did not incur the death penalty, since he had never been the other’s enemy.

That is why I command you: set aside three cities.

And when your God יהוה enlarges your territory, as was sworn to your fathers, and gives you all the land that was promised to be given to your fathers—

if you faithfully observe all this Instruction that I enjoin upon you this day, to love your God יהוה and to walk in God’s ways at all times—then you shall add three more towns to those three.

Thus blood of the innocent will not be shed, bringing bloodguilt upon you in the land that your God יהוה is allotting to you.

If, however, a man who is the enemy of another lies in wait and sets upon [the victim] and strikes a fatal blow and then flees to one of these towns,

the elders of his town shall have him brought back from there and shall hand him over to the blood-avenger to be put to death;

you must show him no pity. Thus you will purge Israel of the blood of the innocent, and it will go well with you.

You shall not move your neighbor’s landmarks, set up by previous generations, in the property that will be allotted to you in the land that your God יהוה is giving you to possess.

A single witness may not validate against an [accused] party any guilt or blame for any offense that may be committed; a case can be valid only on the testimony of two witnesses or more.

the two parties to the dispute shall appear before יהוה, before the priests or magistrates in authority at the time,

and the magistrates shall make a thorough investigation. If the one who testified is a false witness, having testified falsely against a fellow Israelite,

you shall do to the one as the one schemed to do to the other. Thus you will sweep out evil from your midst;

others will hear and be afraid, and such evil things will not again be done in your midst.

When you [an Israelite warrior] take the field against your enemies, and see horses and chariots—forces larger than yours—have no fear of them, for your God יהוה, who brought you from the land of Egypt, is with you.

Before you join battle, the priest shall come forward and address the troops.

He shall say to them, “Hear, O Israel! You are about to join battle with your enemy. Let not your courage falter. Do not be in fear, or in panic, or in dread of them.

For it is your God יהוה who marches with you to do battle for you against your enemy, to bring you victory.”

The officials shall go on addressing the troops and say, “Is there anyone afraid and disheartened? Let him go back to his home, lest the courage of his comrades flag like his.”

When the officials have finished addressing the troops, army commanders shall assume command of the troops.

Shevi’i20:10–21:9

When you approach a town to attack it, you shall offer it terms of peace.

If it responds peaceably and lets you in, all the people present there shall serve you at forced labor.

If it does not surrender to you, but would join battle with you, you shall lay siege to it;

and when your God יהוה delivers it into your hand, you shall put all its males to the sword.

You may, however, take as your booty the women, the children, the livestock, and everything in the town—all its spoil—and enjoy the use of the spoil of your enemy, which your God יהוה gives you.

Thus you shall deal with all towns that lie very far from you, towns that do not belong to nations hereabout.

In the towns of the latter peoples, however, which your God יהוה is giving you as a heritage, you shall not let a soul remain alive.

No, you must proscribe them—the Hittites and the Amorites, the Canaanites and the Perizzites, the Hivites and the Jebusites—as your God יהוה has commanded you,

lest they lead you into doing all the abhorrent things that they have done for their gods and you stand guilty before your God יהוה.

When in your war against a city you have to besiege it a long time in order to capture it, you must not destroy its trees, wielding the ax against them. You may eat of them, but you must not cut them down. Are trees of the field human to withdraw before you into the besieged city?

Only trees that you know do not yield food may be destroyed; you may cut them down for constructing siegeworks against the city that is waging war on you, until it has been reduced.

If, in the land that your God יהוה is assigning you to possess, someone slain is found lying in the open, the identity of the slayer not being known,

your elders and magistrates shall go out and measure the distances from the corpse to the nearby towns.

The elders of the town nearest to the corpse shall then take a heifer which has never been worked, which has never pulled in a yoke;

and the elders of that town shall bring the heifer down to an everflowing wadi, which is not tilled or sown. There, in the wadi, they shall break the heifer’s neck.

The priests, sons of Levi, shall come forward; for your God יהוה has chosen them for divine service and to pronounce blessing in the name of יהוה, and every lawsuit and case of assault is subject to their ruling.

Then all the elders of the town nearest to the corpse shall wash their hands over the heifer whose neck was broken in the wadi.

Thus you will remove from your midst guilt for the blood of the innocent, for you will be doing what is right in the sight of יהוה.

יהוה spoke to Moses, saying:

El Eterno habló a Moshé diciendo:

Command the Israelite people and say to them: Be punctilious in presenting to Me at stated times the offerings of food due Me, as offerings by fire of pleasing odor to Me.

Say to them: These are the offerings by fire that you are to present to יהוה: As a regular burnt offering every day, two yearling lambs without blemish.

Say to them: These are the offerings by fire that you are to present to יהוה: As a regular burnt offering every day, two yearling lambs without blemish.

You shall offer one lamb in the morning, and the other lamb you shall offer at twilight.

And as a meal offering, there shall be a tenth of an ephah of choice flour with a quarter of a hin of beaten oil mixed in—

the regular burnt offering instituted at Mount Sinai —an offering by fire of pleasing odor to יהוה.

The libation with it shall be a quarter of a hin for each lamb, to be poured in the sacred precinct as an offering of fermented drink to יהוה.

The other lamb you shall offer at twilight, preparing the same meal offering and libation as in the morning—an offering by fire of pleasing odor to יהוה.

On the sabbath day: two yearling lambs without blemish, together with two-tenths of a measure of choice flour with oil mixed in as a meal offering, and with the proper libation—

a burnt offering for every sabbath, in addition to the regular burnt offering and its libation.

Revi’i28:11–15

On your new moons you shall present a burnt offering to יהוה: two bulls of the herd, one ram, and seven yearling lambs, without blemish.

As meal offering for each bull: three-tenths of a measure of choice flour with oil mixed in. As meal offering for each ram: two-tenths of a measure of choice flour with oil mixed in.

As meal offering for each lamb: a tenth of a measure of fine flour with oil mixed in. Such shall be the burnt offering of pleasing odor, an offering by fire to יהוה.

Their libations shall be: half a hin of wine for a bull, a third of a hin for a ram, and a quarter of a hin for a lamb. That shall be the monthly burnt offering for each new moon of the year.

And there shall be one goat as a sin offering to יהוה, to be offered in addition to the regular burnt offering and its libation.

On Rosh Hodesh Tevet during Hanukkah, these verses are read in three aliyot (Kohen 1–5, Levi 6–10, Yisrael 11–15) and Revi’i reads from the Hanukkah portion. On Shabbat Rosh Hodesh, the weekly parasha is read and the maftir is 28:9–15.

When you [an Israelite warrior] take the field against your enemies, and your God יהוה delivers them into your power and you take some of them captive,

and you see among the captives a beautiful woman and you desire her and would take her [into your household] as your wife,

you shall bring her into your household, and she shall trim her hair, pare her nails,

and discard her captive’s garb. She shall spend a month’s time in your household lamenting her father and mother; after that you may come to her and thus become her husband, and she shall be your wife.

Then, should you no longer want her, you must release her outright. You must not sell her for money: since you had your will of her, you must not enslave her.

If a householder has two wives, one loved and the other unloved, and both the loved and the unloved have borne him sons, but the first-born is the son of the unloved one—

when he wills his property to his sons, he may not treat as first-born the son of the loved one in disregard of the son of the unloved one who is older.

Instead, he must accept the first-born, the son of the unloved one, and allot to him a double portion of all he possesses; since he is the first fruit of his vigor, the birthright is his due.

If a householder has a wayward and defiant son, who does not heed his father or mother and does not obey them even after they discipline him,

his father and mother shall take hold of him and bring him out to the elders of his town at the public place of his community.

They shall say to the elders of his town, “This son of ours is disloyal and defiant; he does not heed us. He is a glutton and a drunkard.”

Thereupon his town’s council shall stone him to death. Thus you will sweep out evil from your midst: all Israel will hear and be afraid.

I, I am He who comforts you!
What ails you that you fear
Man who must die,
Mortals who fare like grass?

You have forgotten the LORD your Maker,
Who stretched out the skies and made firm the earth!
And you live all day in constant dread
Because of the rage of an oppressor
Who is aiming to cut [you] down.
Yet of what account is the rage of an oppressor?

Quickly the crouching one is freed;
He is not cut down and slain,
And he shall not want for food.

For I the LORD your God—
Who stirs up the sea into roaring waves,
Whose name is LORD of Hosts—

Have put My words in your mouth
And sheltered you with My hand;
I, who planted the skies and made firm the earth,
Have said to Zion: You are My people!

Rouse, rouse yourself!
Arise, O Jerusalem,
You who from the LORD’s hand
Have drunk the cup of His wrath,
You who have drained to the dregs
The bowl, the cup of reeling!

¡Despierta! ¡Despierta!

Of all the sons she bore;

These two things have befallen you:
Wrack and ruin—who can console you?
Famine and sword—how shall I comfort you?

Your sons lie in a swoon
At the corner of every street—
Like an antelope caught in a net—
Drunk with the wrath of the LORD,
With the rebuke of your God.

Therefore,
Listen to this, unhappy one,
Who are drunk, but not with wine!

Thus said the LORD, your Lord,
Your God who champions His people:
Herewith I take from your hand
The cup of reeling,
The bowl, the cup of My wrath;
You shall never drink it again.

I will put it in the hands of your tormentors,
Who have commanded you,
“Get down, that we may walk over you”—
So that you made your back like the ground,
Like a street for passersby.

Awake, awake, O Zion!
Clothe yourself in splendor;
Put on your robes of majesty,
Jerusalem, holy city!
For the uncircumcised and the unclean
Shall never enter you again.

¡Despierta! ¡Despierta!

Arise, shake off the dust,
Sit [on your throne], Jerusalem!
Loose the bonds from your neck,
O captive one, Fair Zion!

For thus said the LORD:
You were sold for no price,
And shall be redeemed without money.

For thus said the Lord GOD:
Of old, My people went down
To Egypt to sojourn there;
But Assyria has robbed them,
Giving nothing in return.

What therefore do I gain here?
—declares the LORD—
For My people has been carried off for nothing,
Their mockers howl
—declares the LORD—
And constantly, unceasingly,
My name is reviled.

Assuredly, My people shall learn My name,
Assuredly [they shall learn] on that day
That I, the One who promised,
Am now at hand.

How welcome on the mountain
Are the footsteps of the herald
Announcing happiness,
Heralding good fortune,
Announcing victory,
Telling Zion, “Your God is King!”

Hark!
Your watchmen raise their voices,
As one they shout for joy;
For every eye shall behold
The LORD’s return to Zion.

Raise a shout together,
O ruins of Jerusalem!
For the LORD will comfort His people,
Will redeem Jerusalem.

The LORD will bare His holy arm
In the sight of all the nations,
And the very ends of earth shall see
The victory of our God.

Turn, turn away, touch naught unclean
As you depart from there;
Keep pure, as you go forth from there,
You who bear the vessels of the LORD!

For you will not depart in haste,
Nor will you leave in flight;
For the LORD is marching before you,
The God of Israel is your rear guard.

About Parashat Shoftim

Israel is to appoint judges and officers in every city, who must judge fairly and take no bribes: "Justice, justice you shall pursue." Difficult cases go to the priests and the judge at the central place of worship, whose rulings must be followed. If Israel appoints a king, he must not accumulate horses, wives or wealth, and he must write a copy of the Torah to keep with him and read all his days. The priests and Levites receive set gifts. Divination and sorcery are forbidden; God will raise up prophets, and the parasha explains how to recognize a false one. Cities of refuge protect those who kill unintentionally. Boundary markers may not be moved, and a matter is established by two or three witnesses. Laws of war exempt the newly married and the fearful, require offering peace first, and forbid cutting down fruit trees. The parasha ends with the ritual of the broken-necked heifer for an unsolved killing.
